CREATION OF A BUSINESS MEMBER ACCOUNT
POLICIES
These Terms and Conditions apply to the use and operation of the Discover Special Value website (‘the website”).
In these Terms and Conditions a reference to;
“Account” means a Member Account or Business Member Account.
“Account Registration Form” means the form a person must complete to create a Member Account.
“Business Member Account” means an Account a person has created for a Business Member.
“Business Member Profile” means a Website page for use by a Business Member.
“Business Registration Form” means the form a person must complete to seek registration of a business to become a Business Member.
“Business Member Representative” means in the case of a corporate Business Member the person listed as the authorised agent of the Business Member on the Website membership database or records for that Business Member.
“Business Services” means those business services a Business Member provides listed on a Business Member profile web page.
“Business Verification Information” means information that verifies aspects of a Business Member such as business certifications, business qualifications, business accreditations, insurance, subcontractor information and other business related information.
“Customer” means any person that uses this Website either as a general user or as a Member.
“Discover Value” means the business Discover Value ABN 41734922341 that owns and manages the website Discover Special Value.
“Member” means a person that has either a Member Account or Business Member Account.
“Member Account” means an Account a person has created.
“Member Services” means paid Website membership services for Members.
“Membership Subscription Fee” means a membership services fee for Member Services.
“Person” means any individual aged over 18 years or a corporate entity.
“Services” means Business Services, Member Services, Website Services, Special Value Features and includes free Website Services.
“Special Value Features” means the features available from the Website which are included with Website Services and Business Services.
“Terms and Conditions” means these Terms and Conditions (and New Terms and Conditions), Website Policies and any other documents or procedures referred to by the Terms and Conditions as being part of these Terms and Conditions.
“Us” means You and Discover Value.
"We" or “Our” means Discover Value.
“Website” means the Discover Special Value website www.discoverspecialvalue.com.au.
“Website Policies” means the Privacy Policy, Refund Policy or any other Website policy posted on the Website referred to by the Terms and Conditions.
“Website Services” means those services provided by Discover Value from its Website either as free or paid services to its own Customers.
"You" and “Your” means a Member or Business Member Representative, or any person using the Website Services as a Customer.
If there is an inconsistency between these Terms and Conditions and any Website Policy, document or procedure referred to by the Terms and Conditions then the Terms and Conditions are to prevail.
ACCEPTANCE OF TERMS AND CONDITIONS
Prior to using the Services You acknowledge that you have read these Terms and Conditions.
You agree to comply with the Terms and Conditions in Your use of the Website.
You agree that by Your use of the Website and Services You are legally bound by the Terms and Conditions, and Your use of the Website and Services constitutes acceptance of the Terms and Conditions.
You also acknowledge and agree that You must be over 18 years of age to use Business Services, Member Services and paid Website Services.
You agree that Your use of the Website is on an “as is” and “as available” basis.
You may only use the Services if you agree to the Terms and Conditions. If you do not agree with them You are not permitted to use them.
AMENDMENT OF TERMS AND CONDITIONS
We may alter or modify the Terms and Conditions at any time (“New Terms and Conditions “). We will notify Customers and Members in advance where this occurs.
New Terms and Conditions are effective immediately upon posting them on the Website. They replace previous Terms and Conditions or Policies at that time.
Your continued use of the Website and Services is thereafter governed by the New Terms and Conditions.
If You do not agree to any change to the Terms and Conditions then You must immediately stop using the Services.
You agree that by Your use of the Website and Services after New Terms and Conditions commence You are legally bound by the New Terms and Conditions, and Your use of the Website and Services constitutes acceptance of the New Terms and Conditions.
Membership
We provide Member Services for Members as set out in these Terms and Conditions. Further membership information is set out here
Member Services include a non-exclusive licence for Members to use their Member Services and use Business Services and Website Services.
Member Accounts
To obtain more Services and to use Special Value Features You will need a website Member Account.
Business Member Accounts
To arrange for a business to provide Business Services from the Website, and for it to use Special Value Features You will need to create a Member Account and then complete the following steps to create a Business Member Account.
Creating a Member Account
You are required to complete the Account Registration Form on the Website and complete the following steps to create a Member Account.
It is a condition of having a Member Account that You;
- are at least 18 years of age;
- have only one Member Account;
- only provide complete and accurate information to create and manage Your Member Account;
- provide your name, address, email address and other information that is required to create and maintain Your Account;
- keep your Member Account information current at all times; and
- only use the Member Account in accordance with the Terms and Conditions.
Except where a Business Member Account is created by a person on behalf of corporate Business Member a person cannot create a Member Account for another person without approval from Customer Support.
Member Account communications
After You send a request to create a Member Account You agree that the We can send You communications relating to Your Member Account using the email address You have provided.
A message is confirmed as having been sent to a Member’s email or Member Account messaging address and received by the Member when a Website record shows the Website details of when it was sent and received by a Member.
Member Account security
After You create a Member Account;
- You must ensure that Your Member Account details, password and other confidential Member Account information is kept securely by You at all times; and
- You are not permitted to allow another person to use Your Member Account password to access or use Account.
Management of Your Member Account
You agree to maintain and update Your Member Account information so it is accurate at all times.
You are responsible for managing Your Member Account details and the Services You obtain in accordance with these Terms and Conditions.
You cannot transfer, assign, sell or licence Your Member Account to another person or let another person transfer, assign, sell or licence Your Member Account to another person, or use it contrary to the Terms and Conditions.
Unauthorised access
You are required to advise Customer Support immediately if you become aware of any unauthorised use of your Member Account.
If You permit another person to have unauthorised access to use Your Member Account for any reason (eg; minors) then You are responsible for the consequences of that unauthorised use.
CREATION OF A BUSINESS MEMBER ACCOUNT
Registering a business
To register a Business Member a person must initially have a Member Account. You can then create a Business Member Account.
The Terms and Conditions that apply to a Member Account also apply to a Business Member Account.
Business Member Representative
You must only register a business as a Business Member if You are aged at least 18 years and You are;
- a business owner; or
- authorised to represent the business on its behalf (ie; as a Business Member Representative).
If You register a business as Business Member Representative You agree You have the authority to complete that registration on its behalf.
Registration of a Business Member
You may only register a business with an Australian registered business name and Australian Business Number (ABN). If You need to create a business name or an ABN, or if You need to check information about business registrations more information is available from the Australian Business Register.
To complete a business registration You need to;
- complete the Business Registration Form and forward it to the Website by selecting ‘submit’ on the form;
- complete the Business Member Profile information including at least one Special Value Feature (or more) linked to each Business Service the business provides;
- pay the relevant Membership Subscription Fee; and
- provide any other business related information We require to complete the registration (eg; business background information, Business Verification Information, or other business information relating to the Business Services it will provide from the Website.
Business Member Profile
To complete a business registration and for the business to be able to publicly display its Business Services information from the Website You must complete the Business Member Profile page. The details for inclusion on the Business Member Profile page are set out here. They form part of these Terms and Conditions.
Refusal to register a business as a Business member
We reserve the right to refuse a registration of any business as a Business Member if we are not satisfied it can meet these Terms and Conditions. If a business does not meet the Website registration requirements it can re-apply for registration when it considers it can meet them.
If a person has paid a Membership Subscription Fee for a new Business Member that is not subsequently registered this money will be refunded.
Business Member Representatives
Where a Business Member Representative has completed the registration of a Business Member the person is the authorised agent for that corporate Business Member. This information is included in the Website membership database records.
As a Business Member Representative You must ensure the Business Member complies with the Terms and Conditions at all times.
Where You are listed on the Website membership database records as the Business Member Representative You agree You act as the authorised agent for the Business Member. You also agree that We do not act as agent for the Business Member or any Customers the Business provides Business Services to.
Business images
You agree as the Business Member Representative You have authority to upload and display business information and images You add to the Business Member Profile web page and that these relate to the Business Services of the Business Member You represent.
You agree that You will not add to the Business Member Profile any information or images which are deceptive or misleading in any way and which infringe the copyright or trademark of any person.
Changing the Business Member Representative
A corporate Business Member may change its Business Member Representative at any time and replace its representative with another person as its authorised agent (“New Business Member Representative”).
The Terms and Conditions apply to the New Business Member Representative from the date of the appointment of the New Business Member Representative.

Members with paid Member Services must pay the Membership Subscription Fee (plus GST) monthly in advance to maintain a current membership.
Members may select one month or quarterly periods during 2013 as their Member Services period.
Membership is automatically renewed on each membership renewal date for the same period as the previous period unless You advise Us 14 days prior to the next membership renewal date that You do not want to continue Your membership.
For Business Members with paid Member Services the renewal of their membership is subject to them carrying out their Business Services in accordance with the Terms and Conditions.
We may alter or change Membership Subscription Fees following reasonable notice to Members.
Membership invoices
Invoices (in AUD) for Member Services are forwarded prior to membership renewal dates to Business Members. GST is added for Australian based transactions.
Membership Subscription Fees can be paid by any of the following ways;
(a) credit card;
(note: the transaction amount will include a standard merchant processing fee of 2.5% of the transaction amount);
(b) direct deposit (EFT) to;

(c) cash.
Membership Subscription Fee payments made by credit card or EFT are received when the payment is cleared.
Business Member Services: 1 March 2013 until 30 June 2013

Application of Policy
The Discover Special Value website is managed by the Discover Value business.
The website and business are both referred to as the ‘Discover Special Value website’ or ‘website’ in this Policy. The website provides ‘website services’ to its own customers.
Nature of Policy
This Policy sets out how Discover Special Value website manages refunds.
The Policy forms part of the Terms and Conditions.
Scope of Policy
The Policy only applies to refunds relating to website services provided by the Discover Special Value website to its customers (‘customers’). More information about customers is set out below.
The Policy also refers to services supplied by businesses that are registered to provide services from the website as service providers.
Purpose of the Policy
Australian businesses are required to apply consumer protection responsibilities by the Commonwealth government. These responsibilities require them to deliver their services at an acceptable service level for their customers (ie; level of service).
Consumer guarantees and refunds
The level of service businesses need to deliver to their customers forms part of a customer guarantee. This is based on what is arranged between customers and businesses. However, this guarantee does not require a business to provide a refund if a customer changes their mind after completing a purchase.
Customers
Customers are either general customers or business customers.
General customers can select types of accounts in the following categories;
- general customer account (free account with specific services); or
- general member account (member account with a specific mix of free and paid services).
Business customers can select types of accounts in the following categories;
- business customer account (free account with a specific services); or
- business member accounts (member accounts with a specific mix of free and paid services).

REFUNDS - DISCOVER SPECIAL VALUE
The Discover Special Value website adds value to its website services by using special value features.
In this way and by using other value-adding services the Discover Special Value website aims to meet;
- the level of service customers were expecting and potentially exceed those expectations; and
- its consumer protection responsibilities.
The Discover Special Value website is not required by the consumer protection responsibilities to provide a refund if a customer changes their mind after completing a purchase of its website services. For example, the purchase of a membership subscription service.
Therefore, a refund will only be given in these circumstances at the discretion of the Discover Special Value website.
Customer concerns
If a customer has a major problem with how the Discover Special Value website business has carried out website services which cannot be fixed, or fixed within a reasonable time by the business, a customer may choose to seek other solutions including a refund from the business.
REFUNDS – SERVICE PROVIDERS
Business members as service providers
Business members may register their own business services on the website in a business member profile as service providers. As service providers they then have access to the special value feature process.
The use of these features can potentially increase their level of service for their customers when they purchase products and services from them using the website services.
Level of service
The Discover Special Value website aims to only register businesses that provide services from the website that consistently meet;
- level of service their customers were expecting for those services; and
- consumer protection responsibilities they have as businesses.
Service provider refund inquiries
If customers of service providers have inquiries or questions about refunds for any products or services they received from service providers these can be followed up directly by contacting the business concerned.
CUSTOMER REVIEW PROCESS
On the completion of services by service providers their customers can use the website review process to provide feedback about services. This is an important way for the website and the businesses to have valuable feedback from customers to assist in providing better overall long term services.
